Your Legal Guide to Shopping with Us

Terms & Conditions

Last updated: August 2026

These Terms & Conditions apply to purchases made through the Essência da Luz online shop. By placing an order, you agree to these Terms & Conditions.

1. About Us

Essência da Luz is operated by:

Waibel e Waibel Lda.
Santo Estevão CP607
8300-047 Silves
Portugal
NIF: PT516234374
Email: info@essenciadaluz.pt

Our online shop is intended for sales to consumers only. If you are interested in purchasing our products for commercial purposes, wholesale or resale, please contact us directly.

2. Products and Product Information

We aim to describe and display our products as accurately as possible.

Many of our products are made in small batches and contain natural ingredients. For this reason, slight variations in colour, appearance, fragrance, texture or other characteristics may occur. Such natural variations do not constitute a defect.

Product images are intended to represent the products as accurately as possible. However, colours may appear slightly different depending on the device or screen used.

Please always read the product information, ingredients and instructions provided on the product page and/or packaging before use or consumption.

3. Prices and VAT

All prices displayed in our online shop are stated in euros (€) and include applicable VAT (IVA), unless expressly indicated otherwise.

Shipping costs are not included in the product price unless stated otherwise. Applicable shipping costs are displayed before completion of the order.

We reserve the right to change our prices at any time. Any price change will not affect orders that have already been confirmed.

4. Orders and Formation of the Contract

Products displayed in our online shop constitute an invitation to place an order.

By completing the checkout process and submitting an order with an obligation to pay, you make a binding offer to purchase the selected products.

After receiving your order, we will send you an order confirmation by email. The purchase contract is concluded when we accept your order.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including an obvious pricing or product information error, suspected fraudulent activity or the unavailability of a product. If payment has already been received for an order that we cannot fulfil, the amount paid will be refunded.

5. Payment

The payment methods currently available may include:

  • Credit or debit card

  • PayPal

  • Apple Pay

  • Google Pay

  • Advance payment by bank transfer

The payment methods available for your particular order will be displayed during checkout.

For orders paid by bank transfer, processing will begin after we have received the payment.

6. Shipping and Delivery

We currently ship within the European Union.

Orders are usually prepared for dispatch within 2–3 working days after receipt of payment. Delivery times depend on the destination and shipping method and will be indicated where possible during checkout.

Shipping costs are displayed before the order is completed.

Occasional delays caused by postal or courier services, public holidays, exceptional circumstances or other events outside our reasonable control may occur.

Further information is available in our Shipping Policy.

7. Right of Withdrawal

If you are a consumer residing in the European Union, you generally have the right to withdraw from your online purchase without giving a reason within 14 days from the day on which you, or a third party designated by you other than the carrier, receives the goods. This reflects the Portuguese rules for distance contracts.

To exercise your right of withdrawal, you must inform us of your decision within the 14-day period by an unequivocal statement, for example by email to:

info@essenciadaluz.pt

You may use our Model Withdrawal Form, but you are not required to do so. You may also exercise your right of withdrawal by sending us any other clear and unequivocal statement informing us of your decision to withdraw from the contract. Portuguese law expressly permits an unequivocal withdrawal statement rather than requiring a particular form.

After informing us of your withdrawal, the goods must be returned without undue delay and no later than 14 days after your notification.

Unless otherwise agreed, you are responsible for the direct cost of returning the goods.

Please handle products only to the extent necessary to establish their nature, characteristics and functioning. You may be responsible for any diminished value resulting from handling beyond what would normally be permitted when examining goods in a shop.

Further information is provided in our Refund & Returns Policy.

8. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply in cases provided for by law.

This may include, in particular:

  • goods made to the consumer's specifications or clearly personalised;

  • goods that are liable to deteriorate or expire rapidly; and

  • sealed goods that are not suitable for return for reasons of health protection or hygiene where the seal has been removed after delivery.

These exceptions come directly from Article 17 of Portugal's distance-contract legislation.

Important: The mere fact that a product is a food or cosmetic product does not automatically remove the right of withdrawal. An applicable statutory exception must actually exist.

9. Refunds Following Withdrawal

Where the statutory right of withdrawal applies, we will reimburse payments received from you, including the cost of our least expensive standard delivery option, in accordance with applicable law.

Additional delivery costs resulting from your choice of a more expensive delivery method are not refundable.

Unless otherwise agreed, reimbursement will be made using the same payment method used for the original transaction and without additional fees.

We may withhold reimbursement until we have received the returned goods or until you provide evidence that the goods have been returned, whichever occurs first.

10. Damaged, Incorrect or Defective Products

Your statutory rights regarding defective or non-conforming goods are unaffected by these Terms & Conditions.

If your order arrives damaged, you receive an incorrect product or you believe a product is defective, please contact us as soon as possible at info@essenciadaluz.pt, preferably including your order number and photographs where relevant.

We will assess the issue and provide an appropriate solution in accordance with applicable consumer law.

Under Portuguese consumer law, the seller is generally responsible for a lack of conformity that becomes apparent within three years of delivery of goods, although the practical remedy depends on the nature of the product and the circumstances.

Nothing in these Terms limits or excludes your mandatory statutory consumer rights.

11. Promotional Codes and Offers

From time to time, Essência da Luz may offer promotional codes, discounts or special offers.

Unless otherwise stated:

  • promotional codes cannot be exchanged for cash;

  • only one promotional code may be used per order;

  • promotional codes may be subject to minimum order values, product exclusions, expiry dates or other conditions communicated with the offer;

  • promotional codes cannot normally be applied retrospectively to completed orders.

We reserve the right to withdraw or amend promotional offers where reasonably necessary, without affecting orders already completed.

12. Intellectual Property

The content of this website, including the Essência da Luz name and branding, logos, photographs, product descriptions, texts, graphics and designs, is protected by applicable intellectual property laws.

Unless expressly permitted by us or by law, such content may not be copied, reproduced, distributed, commercially exploited or used to create derivative works without prior written permission.

13. Liability

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

We are not responsible for losses resulting from improper use of our products, failure to follow product instructions or information, or circumstances outside our reasonable control, to the extent permitted by law.

Nothing in this section affects mandatory consumer rights.

14. Alternative Dispute Resolution

Consumers may have access to an alternative consumer dispute resolution entity.

For contracts falling within its geographical competence, the relevant regional entity is:

CIMAAL – Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve
Edifício Ninho de Empresas
Estrada da Penha, 3.º andar, sala 26
8005-131 Faro
Portugal
Email: info@consumoalgarve.pt

Consumer Arbitration Centre website

Portugal requires businesses established there to provide consumers with information concerning the relevant alternative dispute resolution entities, and the Portuguese Directorate-General for Consumers lists CIMAAL for contracts concluded in the district of Faro.

For further information about consumer dispute resolution bodies in Portugal, consumers may consult the Portuguese Directorate-General for Consumers.

Direção-Geral do Consumidor

15. Applicable Law

These Terms & Conditions and contracts concluded through our online shop are governed by Portuguese law.

Where the customer is a consumer residing in another country, this choice of law does not deprive the consumer of any mandatory protections afforded by the law that would otherwise apply to them.

16. Changes to These Terms

We may update these Terms & Conditions from time to time, for example to reflect changes to our business, website or applicable legal requirements.

The Terms & Conditions applicable to an order are those in force at the time the order is placed.
